THE LEGAL EXPLAINED

The Management of Health and Safety at Work Regulations 1999 generally details what employers are required to do to manage health and safety under the Health and Safety at Work (etc.) Act 1974.

It is important to understand the employers and employees duties set out within each regulation - this ensures your business complies with law and will protect employees and any other person who may be affected by your business activities to stay safe and healthy.

Types of documentation required increases once you employ 5 or more staff.  Typically you would require;

  • A full Health and Safety Policy containing statement of intent, responsibilities and arrangements

  • Suitable and sufficient risk assessments for all activities with control measures applied

  • Staff training which matches their job roles

By taking steps to comply with the law and having procedures in place you will reduce the potential for personal injury and a claim for compensation against you or your company. 

                                                                         COMPETENT PERSON LAW

The Management of Health and Safety at Work Regulations 1999 states here

Every employer shall, subject to paragraphs (6) and (7), appoint one or more competent persons to assist him in undertaking the measures he needs to take to comply with the requirements and prohibitions imposed upon him by or under the relevant statutory provisions and by Part II of the Fire Precautions (Workplace) Regulations 1997.
